The FOI Act requires an application fee and charges to be paid in some circumstances.
Applications for information concerning the personal affairs of the applicant are free. All other requests attract an application fee of $38.00, which should accompany the application. If it does not, a request will be made for payment and no further work will be done on the application until the fee is received.
In addition to the application fee, applications for documents that do not concern the personal affairs of the applicant may attract processing charges for time spent searching for documents and processing the application. The charges that apply are currently $5.80 for each 15 minutes or part thereof (or $23.20 per hour).
If the applicant wants to inspect documents, there will be an access charge of $5.80 per 15 minutes or part thereof ($23.20 per hour) for supervised inspection.
A charge of 20 cents will be payable for single-sided, A4 photocopies, if the applicant requests copies of documents instead of, or as well as, inspection. Copies of larger documents, or of photos, tapes, etc. will be charged on a cost-recovery basis.
Charges can be waived for applicants who are in financial hardship. For the purposes of the FOI Act, this means holders of one of the following cards, who are currently entitled to the benefits conferred by the card:
An offender who holds a card, but is not entitled to the benefits when they make their FOI application, is therefore not considered by the Act to be in financial hardship.
